Terms Of Use

Skilled Trades BC’s (“SkilledTradesBC”) Apprenticeship Portal (the “Portal”) is an online platform that allows Registered Users to access information and submit documents and/or questions related to B.C. skilled trades and apprenticeship programs.

The following Terms of Use set out the terms and conditions under which the Portal is made available to you, the Registered User (“Registered User” or “you” or “your”), to access information and submit documents and questions to SkilledTradesBC. By clicking the “I Agree” box during the registration process and by accessing, using and/or viewing your information included in the Portal, you are indicating your initial and ongoing acceptance and agreement to be bound by these Terms of Use. 

IT IS IMPORTANT THAT YOU CAREFULLY READ AND UNDERSTAND ALL OF THESE TERMS OF USE.

How the Portal Works and Collection, Use and Disclosure of Personal Information

The Portal is designed to allow Registered Users to access general information, their trades training information and submit documents and/or questions related to B.C.’s skilled trades and apprenticeship programs to SkilledTradesBC. Information that is displayed may be related to your submissions, registrations, progress in a trade program and/or information related to your sponsorship participation. 

Any personal information collected from you is collected, used, and disclosed in accordance with British Columbia’s Freedom of Information and Protection of Privacy Act (“FOIPPA”) for the purpose of providing you access to the Portal. The authority to collect personal information comes from Sections 26(c), (d), and (e) of FOIPPA. Access and Portal Use

To access or use the Portal, you must: 

  1. be at least 19 years of age; or
  2. if you are under 19 years of age, have obtained the consent of your parent or guardian to accept this Agreement on your behalf, in which case your parent or guardian is responsible for your use of the Portal; and 
  3. be a Registered User. 

 

If you have not met these requirements, you must not access or use the Portal.

If you do not have an existing Direct Access account, in order to become a Registered User, you must provide a valid e-mail address and supply a password. If you have an existing Direct Access account, in order to become a Registered User, you must verify the information in your existing account, including your email address, and provide a new password. This information will be used to allow you to access your account on the Portal. If authorized by you, your e-mail address will be used to provide you with notices including to participate in surveys and research, and other information regarding B.C.’s skilled trades and apprenticeship programs. Your e-mail address may also be used to assist you if you forget your login information.

If you are accessing your account or the Portal from outside of Canada, you consent to your personal information being accessed from outside of Canada. 

Conditions of Use

By accessing and using the Portal you agree that your use of the Portal is entirely at your own risk and that you will be liable for any failure to abide by these Terms of Use. SkilledTradesBC has no obligation to provide, or continue to provide, the Portal to you and all its functionalities are provided on an “AS IS” and “AS AVAILABLE” basis. 

SkilledTradesBC makes no representations or warranties, express or implied, with respect to:

  • the Portal being free of malware, including viruses, or other harmful components; and
  • the accuracy, completeness or currency of any information available through the Portal.

SkilledTradesBC is not responsible and assumes no liability with respect to any of the information provided to create an account on the Portal. SkilledTradesBC is not responsible for lost, intercepted, incomplete, illegible, misdirected or stolen messages or mail, unavailable connections, failed, incomplete, garbled or delayed transmissions, online failures, hardware, software or other technical malfunctions or disturbances.

If any provision of these Terms of Use is declared by an arbitrator or a court of competent jurisdiction to be invalid, illegal or unenforceable, such provision shall be severed from these Terms of Use and all other provisions shall remain in full force and effect.

The laws in force in the Province of British Columbia will govern these Terms of Use and your use of the Portal. You agree and confirm that your use of the Portal is in compliance with the laws of the Province of British Columbia and Canada, and that you are not prohibited from using the Portal due to any restriction whatsoever and that you have obtained all necessary consents and approvals required or reasonably necessary.

You agree that any action at law or in equity in any way arising from these Terms of Use or your use of the Portal will be resolved by arbitration under the British Columbia Commercial Arbitration Act and the place of arbitration will be Vancouver, British Columbia. 

Amendments

SkilledTradesBC reserves the right to cease providing the Portal at any time without notice. SkilledTradesBC also reserves the right to modify these Terms of Use at any time without notice being provided directly to you. You understand and agree that it is your responsibility to consult the Terms of Use on a regular basis to become aware of any modifications that have been made. If you continue to use the Portal after the Terms of Use have changed, you are deemed to have accepted the modified terms. If you do not agree to be bound by such modified terms, your sole remedy is to cease using the Portal.

Limitation of Liability and Indemnity

Under no circumstances will SkilledTradesBC, its successors, assigns, ministers, officers, employees or agents be liable to you or to any other individual or entity for any direct, indirect, special, incidental, consequential or other loss, claim, injury, or damage, whether foreseeable or unforeseeable, based on: (i) any use, misuse of, or inability to use the Portal, or (ii) any lack of availability, interruptions, deletion or corruption of files, loss of programs or information, errors, defects or delays connected with you accessing or using the Portal.

You agree to indemnify and hold harmless the SkilledTradesBC and its successors, assigns, ministers, officers, employees and agents from any claim, action, demand, loss or damages, including lawyers’ fees, made or incurred by any third party in any way arising out of your use of the Portal.

Suspension or Termination of Use

SkilledTradesBC may at any time and at its sole discretion suspend or terminate your access to and use of the Portal, in whole or in part, if:

  • You do not follow any of these terms and conditions; 
  • Your user ID or password are compromised or insecure, or suspected of being compromised or insecure; or
  • There are administrative purposes.

 

If at any time you no longer wish to agree to be bound by these Terms of Use or for any reason wish to terminate your use of the Portal, you must immediately cease accessing and using the Portal. 

Security

You are responsible for keeping your Portal account login information, including password, secure. You must not share this information with any third party for any purpose. You must notify SkilledTradesBC immediately if you are aware of unauthorized use of your account login information or password.

 

Acceptance of Terms of Use

By activating the “I Agree” button, you are confirming that you have read, understood and agree to be bound by these Terms of Use for SkilledTradesBC’s Portal. If you do not agree to be bound by these Terms of Use, you must not access or use the Portal.
